What is a Kids Protection Plan?

A Kids Protection Plan is a set of instructions, legal documents and even an ID card for your wallet, which you need to have if you have kids at home who count on you for their well-being and care.

If you are in an accident, your Kids Protection Plan will make sure your children are never taken into the custody of Child Protective Services because the police don't have clear instructions as to who has legal authority to take custody of your children.

In 9 simple steps you will have the total assurance of knowing your children will always be raised by the care providers of your choosing, with knowledge of your values, insights, life stories and experiences, even if you can't be there.

Why Do I Need One?

If you are a mom or dad with children at home under the age of 18, you need a Kids Protection Plan. If you don’t have one and you are in an accident or become gravely ill, when the police show up at your house and find your kids home alone or with a babysitter, they have no choice but to call in Child  Protective Services and place your children with strangers until they can determine who is legally entitled to their custody.  And, that’s just the short-term.

For their long-term care, your children would be at the mercy of an overcrowded state court system that could never know as well as you what is in the best interest of your children.

And, if you think a Will is sufficient to protect your kids, you are mistaken. You see, a traditional Will names guardians for your kids for the long-term, but the hearing to determine who those long term care providers will be won't happen until months after that fateful event that deprives your kids of you, potentially leaving your kids in the hands of strangers until everyone can figure out ­what to do. And if competing parties contest for the privilege of caring for your kids, the lack of clear directions from you as to both whom you might want and, equally important, who you never want to raise your kids, may result in long awaited disastrous consequences for your kids.

I Have  A Will - Isn't That Enough?

No, a will is not enough. The police who go to your home after an accident aren’t going to read and interpret your will.  Unless you’ve taken specific steps, they'll have no choice but to place your children into State protective custody, at least temporarily, until other guardians are verified, found, and in many cases, only after prolonged litigation by "concerned" relatives.

A will is very good at giving away property and naming permanent guardians, but you should consider these other things that a typical will does not do to protect your children:

A typical Will does not name immediate, local guardians to stay with your children until the permanent guardians can arrive, nor does it provide the legal authority they need to care for your children, even temporarily.

A typical Will does not give instructions to anyone about the values, insights, stories and experiences you want to leave for your kids.

Typically, people don't carry copies of their Will with them. Thus in an emergency, paramedics and police won't know that you have minor children at home and won't have binding legal guidance as to whom to entrust your children at that time.

A typical Will does not keep anyone you wouldn't want raising your kids from challenging your decisions in Court after you are gone.

A typical Will does not work if you are  temporarily unable to communicate, but still living.
